As consumers or as business owners, entering into a contract is a normal, every day occurence. However, sometimes entering into a contract with someone is like rolling the dice. The best case scenario is that you enter into a contract with an individual or business, they perform in a satisfactory manner under the contract, you pay your money and all parties are happy. Unfortunately, this does not always happen. Sometimes you enter into a contract and no service is performed, but money or property has changed hands. Other times, the service performed is substandard. What should you do as a business owner or individual who just wants what they paid for?
In Pro Per DPS has the solution for you. We have a cost-efficient and effective means of handling breach of contract actions. Whether your action will be filed in small claims court or as a limited or unlimited civil action in Superior Court, we can assist you in handling and winning your case. We have been very successful over the years in assisting our clients in receiving the money, services or property to which they are entitled.
In Pro Per DPS will handle your breach of contract case from the initial stages of the demand letter through the complaint stage. We will also assist you in getting the opposing parties served as well as drafting and coordinating the service of your subpoenas for the witnesses appearance at your trial.
We divide our breach of contract services into a two-part process to provide you the most cost-efficient method of handling your case. First, we draft and send the demand letter to the opposing party directing them to provide you with the performance or the money that you paid. If after ten days the party does not respond, we then draft and file the breach of contract action. Should the party not respond to the demand letter, you have the choice whether to proceed to filing the lawsuit. If you decide to file a small claims or civil action.
Most breach of contract small claims actions can be handled for as little as $250 per case. (If the case is complex and involves multiple defendants, our fees may be slightly higher.)
Should you require only an answer to a small claims action our answers and counter-suites start at $250! We will also assist you by coordinating the filing and personal service of your lawsuit on the opposing parties.
Included in the reasonable price of $250, we will also provide you with five subpoenas for witnesses' appearances at your trial as well as assist in coordinating the personal service of your witnesses. Should you require more than five subpoenas, we will only charge you an additional $15 per subpoena drafted.
We also draft limited civil and unlimited civil complaints for breach of contract as well as respond to complaints. Additionally, we can respond to all types of discovery or draft discovery to assist you in pursuing your litigation matter. In Pro Per is experienced in drafting litigation motions of all types including motions to compel discovery, motion to set aside default or default judgments as well as drafting opposition motions to demurrer and motions to strike. Our costs for these services range from $350 (limited civil complaints and answers) and $400 (unlimited civil complaints and answers) and $400 per motion.
In Pro Per is also happy to provide the Pro Per Plaintiff or Defendant with consultation services to allow you to litigate or defend a breach of contract action without hiring counsel.
